GDPR - processing of personal data

As part of the membership in the Český golfový klub, membership applications are processed. We consider this data to be confidential, we emphasize its safe processing and we keep it confidential.

We would like to inform you below about the processing of personal data of the members, which is carried out by the Český golfový klub z.s., ID No. 26611457, Národních hrdinů 891, Dolní Počernice, 190 12 Prague, registered in the Federal Register of the Ministry of Culture in Prague, sec. L, insert 13264.

I. Basic Provisions

The controller of personal data pursuant to Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter: "GDPR") is the Český golfový klub z.s. ("ČGK")

Personal data means any information about an identified or identifiable natural person. An identifiable natural person is a natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number (membership number), location data, a network identifier or to one or more specific elements of the physical, physiological, genetic, psychological, economic, cultural or social identity of that natural person.

The CGK has not appointed a data protection officer.

II. Sources and categories of personal data processed

  1. The CGK processes the personal data you have provided to it on the basis of a completed club application form.
  2. The CGK processes your identification, contact and contact data necessary for the performance of its activities.

III. Lawful basis and purpose of the processing of personal data

  1. The lawful reason for processing personal data is

    • the performance of the activity between you and CGK pursuant to Article 6(1)(b) GDPR,

    • the legitimate interest of CGK in the provision of direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(f) of the GDPR,

    • Your consent to processing for the purpose of providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(a) GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on certain information society services in the absence of an order for goods or services.

  2. The purpose of the processing of personal data is

    • processing of your application and, consequently, of the membership package, the exercise of rights and obligations arising from the relationship between you and the ČGK; personal data are required for the successful execution of the order (name and address, contact), the provision of personal data is a necessary requirement for the conclusion and performance of the contract, without the provision of personal data it is not possible to conclude the contract or its performance by the administrator,

    • sending commercial communications and other marketing activities.

    • There is no automatic individual decision-making on the part of CGK within the meaning of Article 22 of the GDPR. You have given your explicit consent to such processing.

IV. Data retention period

  1. The controller retains personal data for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and ČGK and to assert claims arising from these contractual relationships (for 15 years from the termination of the contractual relationship).
  2. For a period of time before consent to the processing of personal data for marketing purposes is withdrawn, but no longer than 5 years if the personal data is processed on the basis of consent.
  3. After the expiry of the retention period, the controller shall delete the personal data.

V. Recipients of personal data

The recipient of personal data is the Český golfový klub z.s.

ČGK does not intend to transfer personal data to a third country (to a country outside the EU) or to an international organisation.

VI. Your rights

Under the conditions set out in the GDPR, a member of the CGK has the right to access his or her personal data pursuant to Article 15 of the GDPR, the right to rectification of personal data pursuant to Article 16 of the GDPR, or restriction of processing pursuant to Article 18 of the GDPR. A member has the right to erasure of personal data under Article 17 GDPR, the right to object to processing under Article 21 GDPR and the right to data portability under Article 20 GDPR. The Member has the right to withdraw consent to the processing of personal data in writing or electronically to the address or email of the CGK specified in these Terms and Conditions.

In addition, the member has the right to lodge a complaint with the Data Protection Authority if he/she believes that his/her right to data protection has been violated.

VII. Personal Data Security Terms and Conditions

CGK declares that it has taken all appropriate technical and organizational measures to secure personal data.

CGK has taken technical measures to secure data storage and storage of personal data in documentary form, in particular the use of antivirus programs, the secure storage of backups under passwords, the use of secure access passwords. The Controller declares that only persons authorised by it have access to personal data.

VIII. Final Provisions

By submitting your application from the online form, you confirm that you are aware of the privacy policy and that you accept it in its entirety.

By completing the physical paper application form, you also confirm that you have read and accept the privacy policy in its entirety.

The CGK is entitled to change these terms and conditions. It will publish the new version of the Privacy Policy on its website.

Personal data

All information that relates to a specific identifiable person (e.g. name, surname, address, email, telephone...).

Special categories of personal data

Data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs or trade union membership, and genetic data, biometric data processed for the purpose of uniquely identifying a natural person and data concerning the health or sex life or sexual orientation of a natural person.

Legitimate interest

The Controller's interest in the processing of personal data which you can reasonably expect and which does not unduly interfere with your privacy and data protection rights (e.g. an interest in reasonable commercial communications with clients or an interest in being able to demonstrate proper service provision in the event of a dispute).

Profiling

Automated processing of your data to analyse or predict, for example, your personal and professional behaviour, your economic situation and personal preferences.

Administrator

The administrator is the company Český golfový klub z.s., ID No. 26611457, Národních hrdinů 891, Dolní Počernice, 190 12 Prague, registered in the Federal Register of the Ministry of Culture in Prague, sec. L, insert 13264.

Processor

A person who has been entrusted by the controller with an activity for the performance of which it is necessary to process personal data, e.g. IT service provider, carrier, payment gateway.

Data subject

The person to whom the personal data relates, typically our client.

Purpose

The reason for which the controller uses your personal data.

Retrieved from

The activity that the controller or processor carries out with personal data. Processing includes the mere storage of personal data.
